Abstract

The practice of guardianship implies significant changes in contemporary family structures. Usually, the tutelage processes are legalized in court, but many still happen spontaneously. However, few studies contemplate the reality of these families. In the present article, a theoretical-practical discussion was carried out, through a case study, based on a clinical case in family care in a teaching service of a private university in the south of the country. We sought to understand the relationship between an older sister who becomes a reference of care for the younger sister and the guardianship process between siblings, thinking about the repercussions that not having this process legalized can have for this case. The analysis of family care allowed reflections on the importance of someone occupying the child's caregiver space.
